Terms of Service

Plain summary, for orientation only — the numbered sections below are what actually binds us both. ScaleUp drafts social content for your business. It is free while in beta. Nothing is ever published until you approve it, you keep ownership of everything you upload, and you are responsible for checking a post before you approve it.

1. Who we are and what these terms cover

ScaleUp is an AI marketing co-pilot for small and medium businesses. These Terms of Service (the “Terms”) are the agreement between you and ScaleUp, Business Bay, Dubai, United Arab Emirates (“ScaleUp”, “we”, “us”), covering the scaleup.app website, the ScaleUp web application, and everything we do for you through them (together, the “Service”).

By creating an account, connecting a channel, or using the Service, you accept these Terms. If you are accepting on behalf of a business, you confirm you are authorised to bind that business, and “you” means both you and that business.

If you do not agree with these Terms, do not use the Service.

2. Who may use ScaleUp

To use the Service you must:

  • be at least 18 years old;
  • own or be authorised to act for the business whose profile, brand and social accounts you add;
  • hold the rights needed for every logo, photo, document and piece of text you upload; and
  • not be barred from using the Service, or from using Instagram or Facebook, under any law that applies to you.

One person is the owner of each workspace. Only the owner can approve content for publishing.

3. What ScaleUp does

In its current release, ScaleUp helps you:

  • set up a business profile, goals and brand voice;
  • connect your Instagram and Facebook Page accounts through Meta’s official authorisation flow;
  • upload documents, links and FAQs that the agent uses as source material for your content;
  • generate captions, hashtags and images for social posts;
  • review, edit, approve and schedule those posts; and
  • publish approved posts to your connected Instagram and Facebook accounts.

Other channels and features you may see marked “Coming soon” in the app — WhatsApp, LinkedIn, email and SMS campaigns, Google Business Profile, analytics, leads and CRM, team seats, and the Smart and Autopilot approval modes — are not part of the Service today. They are shown as a preview only, and we make no commitment about whether or when they will ship.

4. Free beta — no fees today

The Service is free while in beta
We do not charge you, and we do not collect card or bank details. Any price you may see in our marketing describes plans we intend to offer later, not a charge you owe now.

Because the Service is free and in beta, it may contain faults, may change substantially, and may be interrupted or withdrawn. Do not rely on it as your only record of your marketing content.

If we introduce paid plans, we will publish updated terms covering fees, taxes, renewal and refunds, and we will tell you before any charge could apply to you. You will never be charged for the Service without agreeing to those terms first.

5. Your account

You sign in with a phone number, an email address, or a Google account. We verify phone and email sign-ins with a one-time passcode. Keep control of whatever you sign in with: anyone who can receive your passcode, or open your Google account, can reach your workspace and approve posts in your name.

You are responsible for everything done through your account. Tell us at support@scaleup.app immediately if you think someone else has access.

6. Connecting Instagram and Facebook

When you connect a channel, Meta gives us an access token for the accounts and Pages you select. By connecting, you authorise us to use that token to publish the content you have approved, and to read the account details and publishing results we show you in the app.

  • You must comply with Meta’s own terms and platform policies. Content that breaches them can be removed or your account restricted by Meta, and we cannot reverse that.
  • You can disconnect a channel at any time in the app, or revoke our access from within your Meta account settings. Either action stops all future publishing to that channel and deletes the stored token.
  • We are not affiliated with, endorsed by, or acting for Meta Platforms, Inc. Meta controls what its APIs allow, and may change or withdraw them without notice to us.

7. Nothing is published without your approval

Safe mode is the only mode
Every post, caption and image generated by ScaleUp waits for the workspace owner’s explicit approval before it can be published. There is no automatic posting, and the Smart and Autopilot modes shown in the app are disabled.

Approving a post means you have read it, you accept it as your own business communication, and you instruct us to publish it. We record who approved what and when.

Once a post is published to Instagram or Facebook, we cannot always unpublish or edit it — that depends on what Meta’s API allows at the time. Treat approval as final.

8. Your content and business information

Your business profile, documents, FAQs, images, captions and posts remain yours. We claim no ownership of them.

You grant us a worldwide, non-exclusive, royalty-free licence to host, copy, process, transmit, adapt and display that material strictly to operate the Service for you: to store it, index it for retrieval, feed it to our AI providers to generate drafts for you, create image derivatives, and deliver approved posts to the channels you connected. This licence ends when you delete the material or close your workspace, except for backups still on their deletion cycle and audit records we must keep.

We do not sell your content, publish it anywhere you have not approved, or use it to train our own or anyone else’s AI models.

9. AI-generated content is a draft, not advice

ScaleUp generates content using AI models, grounded in the business profile, brand voice and knowledge sources you provide. AI output can still be wrong, outdated, generic, or unintentionally similar to someone else’s wording.

You are responsible for what you approve. Before approving, check that the post:

  • states your prices, offers, timings and claims accurately;
  • complies with the advertising, consumer-protection, health, financial and food-safety rules that apply to your trade and country;
  • does not infringe anyone’s trademark, copyright or personality rights; and
  • carries any disclosure your industry or platform requires.

Nothing the agent produces is legal, financial, medical or professional advice. We do not promise any level of reach, engagement, followers, leads or sales.

10. Acceptable use

You must not use the Service to:

  • break any law, or promote anything you are not licensed to sell;
  • post content that is misleading, defamatory, hateful, harassing, sexually explicit, or that exploits or targets children;
  • impersonate another business or person, or post on accounts you do not control;
  • upload malware, or material you have no right to upload;
  • send spam or bulk unsolicited messages;
  • probe, scrape, overload, reverse-engineer or circumvent any part of the Service, its rate limits, or its tenant isolation;
  • attempt to reach another workspace’s data, or use the Service to build a competing product; or
  • resell or provide the Service to third parties as your own.

11. Third-party platforms and services

The Service depends on third parties — Meta, cloud infrastructure, AI model providers, messaging and email providers. Their availability, rules and pricing are outside our control. Where their behaviour prevents us from generating or publishing something, that is not a breach of these Terms by us.

Your use of Instagram and Facebook is governed by Meta’s own terms, directly between you and Meta.

12. Availability and changes to the Service

We aim to keep the Service running but do not promise any uptime level during the beta. We may add, change, suspend or remove features, run maintenance, or impose usage limits such as caps on document size, storage and generation volume.

If we plan to discontinue the Service or a significant feature, we will give you reasonable notice by email or in the app so you can export or copy your content.

13. Ending your use, and what happens to your data

You can stop using the Service at any time. To close your workspace and have your data deleted, disconnect your channels in the app and email privacy@scaleup.app from your registered address.

We may suspend or close your account if you breach these Terms, if your use puts the Service, another user or a third party at risk, if a platform such as Meta requires it, or if we are required to by law. Where it is reasonable and lawful to do so, we will tell you why and give you a chance to fix the problem first.

On closure we delete your workspace content within 30 days, and it drops out of encrypted backups within a further 35 days. We keep audit records of approvals and publishing, and anything else the law requires us to keep, as described in our Privacy Policy.

14. Our intellectual property

The Service — its software, models, prompts, design, and the ScaleUp name and logo — belongs to us and our licensors. These Terms give you permission to use the Service, not any ownership of it. Feedback you send us is something we may use freely, without obligation to you.

15. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranty of any kind, express or implied, including fitness for a particular purpose, non-infringement, and any warranty that the Service will be uninterrupted, secure, error-free, or that AI output will be accurate, original or suitable for publication. Nothing here excludes a right you have under a law that cannot be waived.

16. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, nor for lost profits, lost revenue, lost goodwill, lost or corrupted data, or content published in error after you approved it.

Because the Service is currently free of charge, our total aggregate liability to you for all claims arising out of or relating to the Service is limited to US$100. If you later move to a paid plan, that cap will be replaced by the terms of that plan.

17. Indemnity

You will defend and indemnify us against claims, damages, losses and reasonable costs arising from content you approved or published through the Service, material you uploaded, your breach of these Terms, or your breach of a third-party platform’s rules or anyone’s rights.

18. Changes to these Terms

We may update these Terms. The version and effective date at the top of this page always tell you which version is current — this one took effect on 18 August 2026. For material changes we will give notice in the app or by email before they take effect, and where required we will ask you to accept the new version. We keep a record of which version you accepted and when. Continuing to use the Service after a change takes effect means you accept it.

19. Governing law and disputes

These Terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai, without regard to conflict-of-laws rules, and disputes will be subject to the exclusive jurisdiction of the courts of Dubai, United Arab Emirates. If you are a consumer, this does not deprive you of the protection of mandatory laws of your country of residence. Before starting proceedings, please contact us at support@scaleup.app — most issues are resolved quickly that way.
